APRIL 13, 2006 The Palmer Lake Town Council meeting was called to order by Mayor McDonald at 7:05 p.m. , April 13, 2006 . Attendees:
Pledge of Allegiance: Mayor McDonald May Planning Commission Liaison Trustee Coleman (May 10 and 17, 2006) Item 3: Approval of the Agenda Mayor McDonald referenced a request from Al Fritts, Inn at Palmer Divide, to table his request to the May council meeting. Trustee Parker made a motion to accept the agenda as amended, seconded by Trustee Finan. Motion carried unanimously. Item #4: Consent Items
Trustee Flake made a motion to approve the consent items as presented, seconded by Trustee Finan. Motion carried unanimously. Item #5: Committee Reports Trustee Coleman - Fire Trustee Coleman read fire stats from March 2006
11 calls were Mutual Aid Calls After thanking those who voted, Trustee Coleman cleared the air regarding the department members not turning out to vote for Issue 5 (.05 tax increase), by stating that a number of members are not Palmer Lake residents, but still choose to serve our town. There was a fatality on Highway 105. Trustee Flake Parks and Recreation Fitness for Fun series, yoga and belly dancing, is still being held in the Town Hall. Trustee Flake has been approached about adding jazzercise to the program. The Fishing Derby has been set for June 3. Greg Cook stated Department of Wildlife has scheduled to stock the lake. Clerk Gray reported that the town's insurance would cover the town only, not the fishing derby committee, the chamber of commerce, or any other entity involved. The Blue Columbine Festival has been set for June 10. Chuck Pyle, with Gordon Burt, will be playing from 1:00 pm to 3:00 pm. The Pikes Peak Library will hold a paperback book sale beginning at 12 noon. The town will supply soda and popcorn and will host a 'drought resistant' plant exchange. Little League season has started. The Tri-Lakes Athletic Association will continue to upgrade the field. The Senior Forum will be held on April 29. They are attempting to create a directory for senior services. Kim Makower has indicated he will not be teaching tennis this year. Trustee Flake spoke with Kristi Harris, regarding the tennis grant. There is a possibility that the grant request can amended. An attempt will be made to draw on either volunteers or maybe high school students to hold some classes for this year. Trustee Parker Roads The new grader has been delivered. Application of MagChloride will be started soon. Bob Miner Fountain Creek Watershed Bob supplied a handout indicating that the individual communities had paid into the study as agreed, but that the Army of Corp of Engineers have failed to fulfill their commitment. Katrina cannot be blamed for the Corps lack of fulfillment. Awake the Lake Greg Cook The pavers suffers will be ready for the next water bill mailing. Bill, Tri-Lakes Printing, has donated the cost for the stuffers. Committee members are having trouble getting the railroad to talk with them. They asked for council help. Clerk Gray recommended staff be allowed to make contact, since they have already met, onsite, with a representative of the railroad to discuss changing the water flow. The committee will submit a list of specific questions to be sent to the town's water attorney. Town Staff report: 203 emergency forms have been received and entered into a spread sheet. We are ready to send the list to the lead people on the calling tree. Item #6: Name Change Frontier Lane to Circle Road Trustee Parker reported that Mr. Winnick had sold his home on Frontier Lane . Trustee Parker made a motion to approve the name change and to direct staff to contact the necessary people and change the road signs, seconded by Trustee Finan. Motion carried unanimously. Item #7: Request to Amend a PUD (Planned Unit Development) Inn at Palmer Divide Tabled to May. Item #8: Request for Preservation Easement and Fifteen (15') foot road easement. Mr. Shank was not present. Item #9: Request for a Conditional Use in a CC Zone for a Mixed Dwelling Permit to include a Restaurant, 2 shops, 6 offices at street level and 3 residential lofts. Mr. Campbell requested the approval of the conditional use only with the intention of returning to Planning Commission and Town Council for final approval of the project after having gone through a committee made up of citizens and local businesses. Trustee Coleman stated that on the plan that had been submitted, the driveway on the south side was to narrow. Mr. Campbell responded he was aware of this and would probably ask for a variance. Attorney Gaddis responded, yes, when Mr. Miner asked if the issue of the variance would be heard by the Variance Board. Gary Atkins, Planning Commissioner, stated that planning commission had approved the conditional use only, not the actual project. Dave Wilson and Paula Johnson both asked for council to require the project to be reviewed once again by both boards. Both indicated they would be willing to work with Planning Commission to help Mr. Campbell devise a workable plan. Attorney Gaddis pointed out that this was not a PUD, that the town retained control over the size, width of driveway and setback but not over what color the building is or what business are actually within the building. The town could pass the conditional use only, requiring the applicant to return through the process for the actual project, but only if the applicant request this action. Trustee Flake made a motion to approve the request for a mixed residential and commercial use in the same building contingent upon final configuration comes back through Planning Commission and Town council, seconded by Trustee Coleman. Motion carried unanimously. Item #10: Public Input None Mayor's Report: Mayor McDonald Mayor McDonald thanked all of those who supported her through the years and thanked those who would now be serving on the Town Council. Trustee Parker made a motion to adjourn at 7:59 pm , seconded by Trustee Coleman. Motion carried unanimously. Mayor Parker called the meeting to order at 8:02 pm, April 13, 2006 . Item #1: Oath of Office Judge John Ciccolella Officiating Judge Ciccolella administered the Oath of Office to: Mayor Max Parker Item #3: Motion to Appoint Town Officers Tara Barreth Deputy Court Clerk Trustee Finan made a motion to appoint the Town Officers, Barreth, Beckman, Gaddis, Gray and Smith, seconded by Trustee Coleman. Item #4: Oath of Office for Town Officers Judge John Ciccolella Officiating Judge Ciccolella administered the Oath of Office to the appointed town officers. Item #5: Appointment of Judge Ciccolella, Municipal Court Judge Trustee Coleman made a motion to appoint Judge Ciccolella as Municipal Court Judge for Palmer Lake, seconded by Trustee Miner. Motion carried unanimously. Item #6: Arbor Day Proclamation Mayor Parker read the Arbor Day Proclamation proclaiming April 21, 2006 as Arbor Day in Colorado. The Town's Arbor Day Celebration will be in conjunction with the Palmer Lake Elementary's Pride Day, May 19, 2006. Item #5: Recognition of Outgoing Mayor/Trustee Mayor Parker presented outgoing Mayor Nikki McDonald with a plaque and read the following in her honor: "In small towns like Palmer Lake , it is often easy to contribute. There seems to be chores of a larger municipality, only less people to do them. But there is often a sense of spirit, of participation that drives people of a small town to contribute. Tonight, we tell a story of one of these people. "I've known Nikki McDonald for nearly three years now. In that time she has made an impression on me, one like a role model that society is always looking for these days. Of course, there are folks that have known her for much longer, some as long as she's lived here. "But in my short time, Nikki has been one of those people you can look up to. She has a sense of pride in her community. She has a dedication to her town. She has selflessly given of herself in service. And all of this has been volunteered without anything expected in return. "I believe that she has had a positive effect on the Town of Palmer Lake for as long as people can remember. And that positive effect is what we honor tonight. Personally she has been mentor to me in my time on the council: giving me the history, showing me the 'ropes,' providing sage guidance, and allowing me the freedom to mature. For me she has been a great influence. And I would hope that the citizens of Palmer Lake (and I am sure you do), recognize her the same way. She has been our mayor for six years, has been on the council for about 8 years before that. Her tireless efforts have made Palmer Lake a better place. "So for all those young folks out there who are looking for role models, I say to you 'Look no further.' We have her right here. And to Nikki, I say 'Thank you.' Thanks for all your hard work and devotion to this town." Bill McDonald read the following poem: The Mayor It was six years ago, of I suppose it was fate, when my lovely bride stepped up to the plate. After serving on council and doin' her best, now it was time for the ultimate test. I was sure hopin' it weren't a mistake, for her to be mayor of Palmer Lake . Well six years later, as it came to pass, at least for her family, it was a pain in the ass. Countless hours to takin' the heat, was the price she paid for that mayor's seat. Ok sure there were times when things went well, but more often than not the job was pure hell. So don't be ashamed to give her a cheer, for bustin' her butt for a buck a year. Now don't get me wrong for tellin' my side, cause according to her it was wonderful ride. She served our town of Palmer Lake , with no agenda or personal stake. This is a great town, and that's no joke, but to make it better it'll take regular folk, to volunteer, and do what works, to do what's best and put up with some jerks. I express my thanks to those who are here, who are steppin' up to volunteer, with no personal goals or somethin' to gain, other than to serve and endure some pain. Trustees, and mayor, firemen and cops, are a small town's version of Special Ops and don't overlook our office staff, for they serve us locals with a smile and a laugh. It isn't so easy to give of your time, so some of you new folks, let's get off the dime, now come to the meetings and get some nerve, and let's all support those willing to serve. For this little town is the best place to live, as long as us locals are willing to give. Now in conclusion I'll try to be quick, to express my thanks to mayor Nik, for makin' Life here a wonderful life, by bein' my mayor, and especially my wife. Nikki McDonald thanked all of those who had supported her throughout the years, especially her husband Bill and her daughter, Allie Trustee Finan made a motion to adjourn at 8:24 pm , seconded by Trustee Coleman.
