The Palmer Lake Town Council meeting was called to order by Mayor McDonald at 7:05 p.m., April 14, 2005.

Item 3: Setting the Agenda

TRUSTEE CORNELL MADE A MOTION TO ACCEPT THE AGENDA AS WRITTEN, SECONDED BY TRUSTEE SUMNER. MOTION CARRIED UNANIMOUSLY.

Item #4: Consent Items:

  1. Approval of Minutes - March 10, 2005

TRUSTEE PARKER MADE A MOTION TO APPROVE THE CONSENT ITEMS, AS WRITTEN, SECONDED BY TRUSTEE CORNELL. MOTION CARRIED UNANIMOUSLY.

Item #5: Mutual Aid Agreement - Fort Carson and Palmer Lake Volunteer Fire Department

TRUSTEE SUMNER MADE A MOTION TO APPROVE THE MUTUAL AID AGREEMENT BETWEEN FORT CARSON AND PALMER LAKE VOLUNTEER FIRE DEPARTMENT, SECONDED BY TRUSTEE CORNELL. MOTION CARRIED UNANIMOUSLY.

Item #6: GoCo Grant Partnership - Sue Huismann, President of PTO

Attorney Gaddis reviewed the IGA and found it acceptable.

TRUSTEE CORNELL MADE A MOTION TO APPROVE THE SIGNING OF THE GOCO GRANT PARTNERSHIP, SECONDED BY TRUSTEE PARKER. MOTION CARRIED UNANIMOUSLY.

Item #7: Arbor Day Proclamation

Mayor McDonald read the Arbor Day Proclamation proclaiming April 15 as Colorado Arbor Day with the local celebration being held at Palmer Lake Elementary School, May 6 at 2:45 pm.

Item #8: Committee Reports

Trustee Cornell - Water

Trustee Cornell stated that Well D-2 is not on line at this time and will not be ready for this weekend.

Trustee Flake - Parks and Recreation

Trustee Flake reminded everyone this year's Columbine Festival will be held on June 11, 2005 in conjunction with the Tri-Lakes Chamber's music and art festival, Pikes Peak Library's book sale and the Historical Society's bake sale.

Trustee Parker - Roads

Trustee Parker thanked Bob, Miles and Steve for their performance during the recent snow storm.

Trustee Sumner - Fire

Trustee Sumner reported that this time the Forest Service does not have its own helicopter available, but one could be rented for approximately $2,000.

Trustee Sumner recommended council vote to support Amendment 37 regarding Intermountain Rural Electric Association not having to support the amendment pertaining to alternate forms of fuel. It was Trustee Sumner's position that the people of Colorado voted to support Amendment 37 and therefore council should show support for the voters.

TRUSTEE SUMNER MADE A MOTION TO VOTE NO ON THE BALLOT FOR IREA, SUPPORTING AMENDMENT 37, SECONDED BY TRUSTEE CORNELL. MOTION CARRIED UNANIMOULSY.

Awake the Lake - Jeff Hulsmann

  1. To date, the committee has raised approximately $14,000.
  2. The Park Advisory Committee will be advising the County Commissioners to put up to $30,000 towards the filling of Palmer Lake.
  3. At the Big Splash, t-shirts will be available for $10.00 and pavers will be $75.00. The pavers will be engraved and will be set in the center path of the William Crawford Memorial Garden.
  4. The Discharge Permit was received in the office today.
  5. Fire Chief Beckman was given approval participate in the Big Splash
  6. Jeff will give council as much notice as possible for members to attend the Board of County Commissioner's meeting in support of the request for ATL.

Clerk Gray - Town Staff

Clerk Gray asked for some direction in the matter of putting non-town flyers in with the water bills. Attorney Gaddis recommended a set of guidelines be established.

Douglas County is asking the town and El Paso County to create a better parking area by the motorcycle track in order to accommodate those who will be using the proposed unleashed dog park. Council decided it would not be a wise idea to have more people crossing County Line Road at the bottom of a curving hill.

Trustee Coleman - Community and Economic Development - Buildings

Trustee Coleman stated he would be contacting interested citizens to work on the resolution regarding the lighting of the Star.

Item #9: Request for Commercial Water Line - Inn at Palmer Divide - Allen Fritts

Mr. Fritts offered the following facts in his request for a commercial water line:

  1. eliminating the need to flush the dead end line at MTI
  2. A-2 well is a new source of water since the project was initially approved
  3. the Inn would require only 10 acre feet of water per year
  4. taxes for a commercial venture
  5. tap fee money
  6. on-going revenue to purchase water on a monthly basis
  7. people running the water system don't want it. Only an emotional statement, no study has been done
  8. using a hydrant is no different than a sprinkler system

Council members responded:

  1. due to that portion of water restrictions still in place, no new mainlines can be Built
  2. 10 acre feet could supply approximately 40 residential taps at 6,700 gallons per household
  3. due to the timeframe cited in the code book, does the entire project need to go back to planning commission?
    Attorney Gaddis stated that since the building process had already started, than no he would not need to return to planning commission.
  4. Several Trustees stated they did not have enough information regarding the history and recommend the issue of a water line be returned to planning commission.
    Attorney Gaddis stated if planning commission determined the issue to be a minor change to a PUD, then Planning Commission could rule on the issue and it would not be sent to Council. If Planning Commission determined the issue to be a major change to a PUD, the Planning Commission would recommend either approval or denial to Council.

TRUSTEE COLEMAN MADE A MOTION TO SEND THE ISSUE OF THE WATER SOURCE BACK TO, SECONDED BY TRUSTEE PARKER. 5 AYE - 1 NAY, MOTION CARRIED.

Item #11: Public Input

The three citizens listed above expressed their opposition to the town's co-sponsoring of the Film Festival scheduled for April, May, June and July of 2005.

TRUSTEE PARKER MADE MOTION TO ADJOURN AT 8:58 P.M., SECONDED BY TRUSTEE CORNELL, MOTION CARRIED UNANIMOUSLY.

Approved as written or amended this 12th day of May, 2005.
