The Palmer Lake Town Council meeting was called to order by Mayor Parker at 7:17 p.m., May 11, 2006.

Before the Pledge of Allegiance, Trustee Allen presented Mary Coleman, who has attended hours of meetings, a special 'cushion' to make her stay at our meetings more 'endurable.'

Mayor Parker presented the 'rules of order' for public meetings. All discussions will be fair and balanced, audience and council members will be asked to raise their hands and wait to be recognized before speaking.

Members of the audience will be asked to approach the podium and state their name and physical address. Each additional time they step up to speak, they will be required to again state their name and address.

All cell phones and pagers will be turned down.

Item 3: Approval of the Agenda

TRUSTEE FLAKE MADE A MOTION TO ACCEPT THE AGENDA AS PRESENTED, SECONDED BY TRUSTEE MINER. MOTION CARRIED UNANIMOUSLY.

TRUSTEE FLAKE MADE A MOTION TO APPROVE THE CONSENT ITEMS AS PRESENTED, SECONDED BY TRUSTEE COLEMAN. MOTION CARRIED UNANIMOUSLY.

Item #5: Payment of Bills – April, 2006

Attorney Gaddis stated it is not necessary to separate the payment of the bills from the consent items.

TRUSTEE PARKER MADE A MOTION TO APPROVE THE CONSENT ITEMS AS PRESENTED, SECONDED BY TRUSTEE FINAN. MOTION CARRIED UNANIMOUSLY.

The Department and the Fireworks Committee, joint Easter Sunday Pancake Breakfast was a big success. Thanks to all who helped and to those who came out and supported them.

Reminder, the star will be lit for Memorial weekend from Friday night to Monday night.

The Elephant Rock Bike Race is June 4th from 7:00 am to 4:00 pm, watch out for the riders.

Bodhicitta Bakery, located in the strip mall on Highway 105, will be having a pizza night on June 16th to help fund the fire engine. Pizzas sell for $11.99, half of the price will put towards the engine.

Trustee Allen (for Trustee Finan) – Police

The process for the selection committee for the hiring of a new police chief was focused, smooth and orderly. Members of the committee included Mayor Parker, Trustees Finan, Allen and Girlando, Chief Smith, citizen representative Becky Albright and John Tarbert who is currently employed by Denver RTD. Trustee Allen thanked each of them for bringing their expertise to the committee.

As spokesman for the committee, Trustee Allen recommended Michael 'MC' Williams to council as their choice for Chief of Police.

Chief Dale T. Smith spoke briefly about 'MC's background and qualifications before introducing him to council.

'MC' stated Palmer Lake is choosing him more so than he is choosing Palmer Lake .

TRUSTEE ALLEN MADE A MOTION FOR THE CONDITIONAL APPROVAL OF HIRING MICHAEL ‘MC' WILLIAMS, SECONDED BY TRUSTEE GIRLANDO. MOTION CARRIED UNANIOUSLY.

Trustee Flake – Parks and Recreation

A letter has been written to the CTA with a proposal to amend the grant originally submitted by Mr. Makower. Contact was made with Paul Kardel, tennis pro at Woodmoor Country Club and the High School tennis coach regarding resurfacing of the Glen Park tennis courts and a program to be set for a reopening of the tennis courts after they have been resurfaced.

Parks & Rec have purchased a gas powered, extended lopper for reaching the higher branches

Thank you to Eileen Facinelli for a great Easter Egg Hunt.

Bookmarks are available advertising the Blue Columbine Festival. The Festival has been set for June 10. Chuck Pyle, with Gordon Burt, will be playing from 1:00 pm to 3:00 pm. The Pikes Peak Library will hold a paperback book sale beginning at 12 noon. The town will supply soda and popcorn and will host a 'drought resistant' plant exchange.

The Senior Forum was held on April 29. The main focus of the forum was a Senior Center in the Tri-Lakes area, transportation and senior housing.

Jim Sawatzki is working on a new documentary focused on the history of Palmer Lake Chautauqua's. The documentary is scheduled for completion in 2007. The Chautauqua were held in Palmer Lake during the years 1887-1910. Mr. Sawatzki has asked Palmer Lake to co-sponsor the production. Trustee Flake indicated the $500 budgeted for the film festival could be slated for sponsorship of this production.

Trustee Girlando – Water

Trustee Girlando will be meeting with Steve and will be reporting on water usage and scheduled projects.

Trustee Miner – Economic and Community Development

Trustee Miner reported she had met with Bill Roach, owner of Wild Bill's and the current director of Tri-Lakes Chamber of Commerce. The subject of the meeting Highway 105 Streetscape.

Mayor Parker – Mayor's Report

Mayor Parker quoted the town codes regarding the fire ban and that fireworks are banned. Citizens were also reminded that the bears are out of hibernation, that per town codes, no garbage should be set out until the morning of pickup.

The PPACG meeting this month focused on PPAAA, Pikes Peak Area Association on Aging. PPAAA are co-sponsors of the Senior Forum.

Bob Miner – Fountain Creek Watershed

The Mennonite Church held a silent auction to support seniors. They are still in need of additional funding.

Bob supplied a handout consisting of the minutes of previous meeting and also reported there is still a problem with the Army of Corp of Engineers fulfilling their commitment.

Awake the Lake – Greg Cook

$1200 additional money was raised by the pavers stuffers sent out with the last water billing. The committee has questions ready to be submitted to the Town's water attorney. Greg expressed his thanks to the Mayor and town staff in dealing with the railroad.

Town Staff report:

The ‘Drive by Chipping' program has begun. The cost is $30.00 per hour. Anyone wishing to take advantage can sign up by either stopping by or calling the town office.

Trustee Coleman expanded on the lighting of the Memorial Star. Anyone wishing to have a remembrance publish in the paper needs to have the information to the town office no later than 4:00 pm, Thursday, May 18.

Item #7: Request to Amend a PUD (Planned Unit Development) – Inn at Palmer Divide
Al Fritts

Mr.Fritts asked council to divide Lot 4 into to lots, 13 acres and 14.12 acres.

Issues:

  1. Water from the MTI ( Clark #1) Well – according to Water Attorney Sperling, this well is a municipal well and can be used to sell water to other users.
  2. Access from Highway 105. Can two entities own one driveway?
  3. The newly created lot will still fall under the PUD guidelines.
  4. After studying the Comprehensive Plan no reason could be found to not support the subdivision.
  5. It is up to the seller to disclose any information regarding zoning restrictions.

Trustee Allen made a motion to recommend the amendment to the PUD to divide a single lot into two lots contingent upon approval of the Town Engineer regarding the drainage plan and to be clearly noted on the recorded plat, seconded by Trustee Flake. 5 Aye, 1 Nay, motion carried.

Attorney Gaddis stated the document, as presented, did not meet the requirements of a replat. It was up to the board whether the plan needed to be returned to Planning Commission for approval. It is not appropriate for the issue of water to be referenced on the replat, but it is appropriate for the drainage, including easements, be included. Even though the land has been subdivided, the property cannot be sold without a recorded plat.

Mr. Fritts responded that refinances is an issue, that he would not be able to receive formal approval for another 2 months. Trustee Coleman stated that possibly Mr. Fritts could go to his lender and ask for an extension, that the replat process was only a formality.

Item #8: Request for Preservation Easement and Fifteen (15') foot road easement.

Mr. Shank noted the description listed above was missing that portion of Lot 5, as indicated on the submittal papers.

Trustee Coleman stated the easements, with drawings, needed to be recorded.

The true legal description of the location of the road easement is: The west 30 feet of Lot 4, together with the east 30 feet of Lot 5, Block 11, Pine-Crest Tri-District Assembly Ground Addition No. 1.

Item #10: Public Input

Mayor Parker introduced the subject of the selection process for Mayor Pro-tem as stated in Chapter 2, Palmer Lake Municipal Code. Reference was made to Trustee Allen receiving the largest number of votes, while Trustee Coleman had seniority on the board and Trustee Miner had experience and had done a good job in the past.

Trustee Girlando made a motion to appoint Trustee Richard Allen as Mayor Pro-tem, seconded by Trustee Flake. Motion carried unanimously.

Kurt Ehrhardt, 813 Meadow Lane and owner of the West End Center asked for council to once again look into the feasibility of supplying water to the east end of town by means of creating a small, town owned system. Council responded they would look into the idea.

Trustee Coleman made a motion to adjourn at 9:30 pm, seconded by Trustee Miner. Motion carried unanmously.
