JULY 14, 2005 The Palmer Lake Town Council meeting was called to order by Mayor McDonald at 7:05 p.m., July 14, 2005. Attendees:

Item 3: Setting the Agenda TRUSTEE CORNELL MADE A MOTION TO APPROVE THE AGENDA AS WRITTEN, SECONDED BY TRUSTEE FINAN. MOTION CARRIED UNANIMOUSLY. Item #4: Approval of Minutes - June 9, 2005 TRUSTEE CORNELL MADE A MOTION TO APPROVE THE MINUTES OF JUNE 9, 2005, AS WRITTEN, SECONDED BY TRUSTEE PARKER. MOTION CARRIED UNANIMOUSLY. Item #5: Payment of Bills TRUSTEE FINAN MADE A MOTION TO APPROVE THE PAYMENT OF THE BILLS, SECONDED BY TRUSTEE COLEMAN. MOTION CARRIED UNANIMOUSLY. Item #6: Committee Reports Trustee Coleman - Economic and Community Development and Buildings The Living Word Chapel has invited the Town board, all town employees and firemen to a Bar-B-Q on July 16 from 12:00 to 3:00. The Youth Group from The Little Log Church has offered to paint the trim on the town hall. Trustee Cornell - Water There have been a lot of water breaks this summer. The Lake looked good for the 4th of July. The water was shut off on June 27th due to the town being out of priority. Trustee Finan - Police A thank you was extended to Mike Brennan for the long day (18 hours) he put in on the 4th of July and also his officers. There was an estimated 15,000 to 20,000 people in attendance. The plan is to attempt to raise more money in order to station more officers in the crowd to stop the fireworks in the crowd. Trustee Flake - Parks and Recreation A thank you was extended to Jeff & Troy, shoot team. All of the fire departments and Rob Lee, Assistant Fire Chief, who stood in for Chief Beckman. The town staff, Nick Casale and Sue Guill and her girls for clean-up on July 5th. Nick Cooper has been hired as a part-time, seasonal park maintenance employee. Trustee Flake stated Dan Fraley had thanked the town board for standing up for them and allowing the use of the Town Hall. Rogers Davis sat on the discussion panel and took part in 2 of the film dialogues. It was felt some bridges were built in this area. Trustee Parker - Roads Thanked Bob Radosevich for having the roads in good shape for the 4th and CDOT for having completed the main portion of the Highway 105 paving project before the 4th. Trustee Parker asked for council approval to enter into a contract with Schmidt Construction to repave High Street, Forest View Circle and Forest View Way. TRUSTEE PARKER MADE A MOTION TO APPROVE THE BID FOR THE BOMAGING AND REASPHALTING OF HIGH STREET, FOREST VIEW CIRCLE AND FOREST VIEW WAY IN THE AMOUNT OF $124,303.22, SECONDED BY TRUSTEE SUMNER. MOTION CARRIED UNANIMOUSLY. Trustee Sumner - Fire Trustee Sumner again thanked the Palmer Lake Volunteer Fire Department and the surrounding departments for a great show. At the request of Chief Beckman, Trustee Sumner read Chapter 8.10 and asked Attorney Gaddis to insert verbiage that would restrict the placing of wood in containers. :( Trustee Sumner informed the council that he had sold his house and that this would be his last meeting. Mayor McDonald - Mayor's Report Mayor McDonald stated she was proud to be a citizen of Palmer Lake especially during the 4th of July celebration. Awake the Lake - Greg Cook The committee has raised $25,381.73. He will need the actual meter reading in order to let El Paso County know how much water was put into the lake. More details will be given at the next meeting regarding the Water Conservancy Board. Item #7: Request for New Business License - Extek Cyrogencis - David Hilton
TRUSTEE PARKER MADE A MOTION TO APPROVE THE BUSINESS LICENSE FOR EXTEK CRYOGENICS, SECONDED BY TRUSTEE FINAN. MOTION CARRIED UNANIMOUSLY. Item #8: Request for New Business License - Grunow Enterprises - John Grunow
TRUSTEE FINAN MADE A MOTION TO APPROVE THE BUSINESS LICENSE FOR GRUNOW ENTERPRISES, SECONDED BY TRUSTEE SUMNER. MOTION CARRIED UNANIMOUSLY. Item #9: Request for New Business License - Bonnette - Bonnette DeLuca TRUSTEE SUMNER MADE A MOTION TO APPROVE THE BUSINESS LICENSE FOR BONNETTE, SECONDED BY TRUSTEE COLEMAN. MOTION AMENDED BY TRUSTEE FLAKE TO INCLUDE "CONTINGENT UPON BRINGING IN HER STATE SALES TAX LICENSE," SECONDED BY TRUSTEE PARKER. MOTION AND AMENDMENT CARRIED UNANIMOUSLY. Item #10: Ordinance 4 - 2005 - Regulation of Toy Cars "Toy Vehicles" This ordinance will be passed as an emergency ordinance and will allow any violators to be summoned into our local court. Attorney Gaddis responded yes to Trustee Parker's question if the ordinance was patterned after the State law. TRUSTEE FINAN MADE A MOTION TO APPROVE ORDINANCE 4, 2005, SECONDED BY TRUSTEE PARKER. MOTION CARRIED UNANIMOUSLY. Item #11: Ordinance 5 - 2005 - Re-vacation of a portion of First Street - The re-vacation of First Street is being done to create a paper trial for use by title companies. The vacation of Laughing Water is for a land exchange to fix a portion of Trinidad Lane. TRUSTEE PARKER MADE A MOTION TO APPROVE ORDINANCE 5, 2005, SECONDED BY TRUSTEE CORNELL. MOTION CARRIED UNANIMOUSLY. Public Input: Jim Burnett, Western Enterprises, stated he was addressing the board in support of Troy Oliver and in response to a call received from Mr. Jim Rhatigan regarding problems with the 4th of July fireworks show. Mr. Burnett presented and read from a document showing the types and sizes of shells used and a safety perimeter map disputing all of Mr. Rhatigan's allegations. The handout included documentation listing certifications, licenses and other credentials for the members of Western Enterprises. Troy Oliver thanked all personnel who had assisted in his care and all of the citizens who had expressed their concerns. Mayor McDonald thanked both Troy and Jim for a wonderful show. :( Again, Trustee Sumner stated that this was his last meeting and that it had been an honor and privilege to serve with the current board and for the citizens of Palmer Lake.
