SEPTEMBER 8, 2005 The Palmer Lake Town Council meeting was called to order by Mayor McDonald at 7:00 p.m., September 8, 2005. Attendees:

TRUSTEE CORNELL MADE A MOTION TO APPROVE THE CONSENT ITEMS, AS WRITTEN, SECONDED BY TRUSTEE FINAN. MOTION CARRIED UNANIMOUSLY. Item #5: Motion to Approve Jim Girlando as Trustee TRUSTEE PARKER MADE A MOTION TO APPROVE THE APPOINTMENT OF JIM GIRLANDO AS TRUSTEE, SECONDED BY TRUSTEE COLEMAN. MOTION CARRIED UNANIMOUSLY. Item #6: Oath of Office - Jim Girlando The Oath of Office for Jim Girlando was administered by Attorney Gaddis. Item #7: Updated Committee Reports Trustee Coleman - Economic and Community Development and Buildings The Annual Railroad Festival that will be held on September 24th with a Swap meet at the elementary school and the trains on display at the fire station and town hall. Sylvia Amos, Palmer Lake Country Store will be serving a Hobo Stew, profits will be going to the fire engine fund. The letter of appreciation for Jim Burnett was signed by all trustees. The Youth Group from the Little Log Church completed painting the trim on the town hall. Trustee Coleman extended a thank you to the group. Trustee Cornell - Water Both reservoirs are full. Work is progressing on replacing the mainline on South Valley. Trustee Finan - Police Trustee Finan reported that Chief Smith had circulated a memo regarding the change in how patrols are done due to the increase in gas prices. Officer Hamilton submitted a letter of resignation. Trustee Finan turned the floor over to Chief Smith to present his candidate for replacing Officer Hamilton. Chief Smith introduced Philip Donner. Officer Donner has been a part-time officer with the town logging in approximately 500 patrol hours. It is customary for a part-time officer to be promoted to full-time. This gives the chief and the trustee the opportunity to observe the potential officer. TRUSTEE FINAN MADE A MOTION TO APPROVE PROMOTING PHLLIP DONNER FROM PART-TIME TO FULL-TIME OFFICER, SECONDED BY TRUSTEE PARKER. MOTION CARRIED UNANIMOUSLY. Trustee Flake - Parks and Recreation Trustee Flake reported we are still waiting to hear from Home Depot regarding contact that was made to the town office offering to help upgrade a park. The suggestion was given to Home Depot to build a playground adjacent to the Youth Ball field. Phillip Beckman has been hired a part-time, seasonal part maintenance worker. The Blue Columbine Festival will be held on the 2nd Saturday in June 2006. The festival was first started as a small town activity for the citizens' of Palmer Lake. Kim Makower forwarded a Certificate for 'Tennis in the Park Community - 2005'. Trustee Flake thanked Kim for the resurfacing of the tennis courts in 2003. Trustee Parker - Roads Trustee Parker reported the re-surfacing of High Street, Forest View Way and Forest View Circle has been completed along with the sealing of Shady Lane. The town is waiting for a response from the developers of Kemper's Filing regarding the off-site improvements. The roads department has purchased a 500 gallon tank for gasoline to help offset the high cost of fuel and for use in an emergency. Mayor McDonald - Fire
15 were Mutual Aid Calls The department had their ground ladders tested and recertified. Members attended the Pikes Peak Firefighters Association muster and parade and also attended the 2005 Fire-Rescue international expo in Denver. An appreciation award was presented by the City of Cripple Creek, Pro-Promotions & the Salute to American Veterans Rally Committee. And ... Place House Numbers where they can be seen from the road. Mayor McDonald- Mayor's Report The preliminary budget will be presented at the October meeting. All public is welcome. There will be a change in Trustee Committees, Trustee Coleman will head Fire and Trustee Girlando will head Economic and Community Development and Buildings. Fountain Creek Watershed - Bob Miner The group has not met for 3 months. Mr. Miner referenced the attachments to the application to the Variance Board, wanting to change manner in which the Hillside Ordinance was written and the extension of the MTI driveway. Mayor McDonald asked Mr. Miner to wait until public input to address these issues. Awake the Lake - Jeff Hulsmann No report. Staff - Liquor License Procedures Clerk Gray asked for council to review the liquor license procedures as submitted by Attorney Gaddis. The procedures, with amendments, were adopted by El Paso County Board of County Commissioners in February 2004. Attorney Gaddis will reword the section regarding the radius of survey for the October meeting. Request for New Business Licenses: Item #8: Esthetician@Imagine Salon & Spa - RaeAnne Soles T RUSTEE FINAN MADE A MOTION TO APPROVE THE BUSINESS LICENSE FOR ESTHETICIAN@IMAGINE SALON & SPA, RAEANNE SOLES, SECONDED BY TRUSTEE CORNELL. MOTION CARRIED UNANIMOUSLY. Item #9: Counter Revolution, Inc. - Christian Walters Not in attendance. Item #10: Jim & Maggie Amato - Jim & Maggie Amato TRUSTEE PARKER MADE A MOTION TO APPROVE THE BUSINESS LICENSE FOR JIM & MAGGIE AMATO, SECONDED BY TRUSTEE CORNELL. MOTION CARRIED UNANIMOUSLY. Item #11: Clara Jean's - Clara Smith TRUSTEE FINAN MADE A MOTION TO APPROVE THE BUSINESS LICENSE FOR CLARA JEAN'S, CLARA SMITH, SECONDED BY TRUSTEE CORNELL. MOTION CARRIED UNANIMOUSLY. Item #12: Public Input Judith Harrington, in the absence of Greg Cook, wanted council to know the Awake the Lake Committee was still raising money by selling pavers, caps, shirts and cd's. Bob Miner asked why he was stopped under his committee report. Before this issue could be discussed, Trustee Parker asked Mr. Miner if he had called the last Variance Board meeting to order without a quorum. Mr. Miner responded no and wanted to know where Trustee Parker got his information. Mayor McDonald stopped the discussion and called for a motion to enter into executive session for legal advice. TRUSTEE CORNELL MADE A MOTION TO ENTER INTO EXECUTIVE SESSION FOR LEGAL ADVICE AT 8:20 P.M., SECONDED BY TRUSTEE PARKER. MOTION CARRIED UNANIMOUSLY. TRUSTEE CORNELL MADE A MOTION TO EXIT EXECUTIVE SESSION AND RETURN TO THE REGULAR MEETING AT 8:31 P.M., SECONDED BY TRUSTEE FINAN. MOTION CARRIED UNANIMOUSLY.
