AN ORDINANCE INCREASING DOG LICENSING FEES
WHEREAS, The Town of Palmer Lake has not increased the dog licensing fees since 1978; and
WHEREAS, The cost associated with the licensing of dogs have increased and the Town wishes to authorize licensed veterinarians to sell the dog licenses within the town limits of the Town of Palmer Lake
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF PALMER LAKE, EL PASO COUNTY, COLORADO, AS FOLLOWS:
Section 1. Section 2. of Ordinance 18, 1992, Ordinance 7, 1987, Section 1 of Ordinance 9, 1984, and Section 7.08.120 of the Palmer Lake Municipal Code are amended to read as follows:
Section 7.08120 Fees. The following fees shall be charged by the Town of Palmer Lake:
- Impound Fees: For the impounding of any dog hereunder, there shall be an impound fee chargeable in the amount of ten dollars ($20.00); for the care of any such dog impounded in the animal shelter, there shall be a daily fee chargeable in the amount of ten dollars ($20.00) per day, or fractions thereof, or the actual charge to the Town of Palmer Lake from the Animal Shelter, whichever is greater; for the posting of notice, a charge of five dollars ($10.00).
- License Fees:
- For each non-neutered male and non-spayed female dog, sixteen dollars ($16.00) The license for non-neutered or non-spayed dog may be issued upon presentation to the Town Clerk of an inoculation certificate and payment of the appropriate fee; The Town also authorizes any licensed veterinarian with an office in the Town of Palmer Lake to sell the license for non-neutered or non-spayed dogs. The charge for the license shall be that set by the Town Board. The veterinarian may retain one dollar ($1) for each license sold and remit the balance to the Town Clerk weekly. The Town Clerk shall make such regulations as she deems appropriate to control the sale of licenses by town veterinarians.
- For each neutered male and spayed female dog, six dollars ($6.00). The license for spayed or neutered dogs may be issued upon presentation of the Town Clerk of an inoculation certificate, a certificate signed by a Veterinarian stating the dog has been spayed or neutered, and the payment of the appropriate fee. The Town also authorizes any licensed veterinarian with an office in the Town of Palmer Lake to sell the license for neutered or spayed dogs. The charge for the license shall be that set by the Town Board. The veterinarian may retain one dollar ($1) for each license sold and remit the balance to the Town Clerk weekly. The Town Clerk shall make such regulations as she deems appropriate to control the sale of licenses by town veterinarians.
Section 2. Severability. It is hereby declared to be the intention of the Board of Trustees of the Town of Palmer Lake, Colorado that the sentences, clauses and phrases of this ordinance are severable, and if any sentence, clause or phrase of this ordinance be declared unconstitutional or invalid by the valid judgment or decree of Court of competent jurisdiction, such unconstitutionality or invalidity shall not affect any of the remaining sentences, clauses or phrases of this ordinance since the same would have been enacted by the Board of Trustees without the incorporation of any unconstitutional or invalid sentence, clause or phrase.
Section 3. Publication and Effective Date. The Town Clerk shall certify to the passage of this ordinance and cause notice of its contents and passage to be published or posted. This ordinance shall become effective thirty (30) days after the date of publication.
