Planning Commission Meeting
January 18, 2006

The Palmer Lake Planning Commission was called to order by Chairperson Cressman at 7:05 p.m. in the Palmer Lake Town Hall.

ITEM #1: Call to Order: 7:05 p.m.

ITEM # 2: Comments by Commissioners, Staff or Public on items not on the agenda

No public input

ITEM # 3: Approval of Minutes – December 21, 2005

Not enough Commissioners to vote from that meeting. (Only 2 Commissioners were present from the December meeting) Held over until February, 2006.

ITEM# 4: Request for a Request for a tower to be placed in an M1 zone – Cingular Wireless – Marti Laird
(Nick & Darlah Kapusta) 579 County Line Road

Mr. Laird is asking that 1 cellular tower to be approved not to exceed 30' ft.

Commissioner Cornell made a motion to recommend the conditional use for a (one) cellular tower to placed at the property located at 579 County Line Road, with the understanding that any additional towers or any changes must be presented to the Planning Commission and Town Council for final approval, seconded by Commissioner Cooper. Motion carries unanimously.

ITEM #5: Request for an amendment to a PUD Master Plan- Living Word Chapel – Brian Bucher

Mr. Bucher is asking on behalf of Living Word Chapel for the approval for updating and changing the current approved Final PUD. The foot print and square footage will stay the same. The project would be phased over approximately 10 years.

Concerns: Drainage, HWY 105 access with increased traffic and the placement of the proposed building in phase 5 (along the east property line).

Commissioner Cornell made a motion to recommend to Town Council the approval of the amendment to the PUD Master Plan – Living Word Chapel – with the caveat that all phased projects come before the planning commission and town council before any construction to address any of the above concerns seconded by Commissioner Cooper. Motion carries unanimously.

ITEM# 6: Request for a vacation and replat- Lakeview Heights Unit 2, 4th amendment – Herb Rea

For the purpose of combining seven (7) adjoining lots into three (3) adjoining lots as follows:

  • 71054-26-031, 71054-26-030, 71054-26-029 = Lot 21A
  • 71054-26-028, 71054-26-027 = Lot 23A
  • 71054-26-026, 71054-26-025 = Lot 25A

Concerned residents:

Patty Brooks, Jenny Cox, Corrine Oreter, Les Nelson – Have the following concerns:

  • Disturbance has already been done with the sewer line
  • Houses should be built as platted which would require the access off of Cathedral
  • Drainage
  • Hillside
  • Driveways off of a already busy road

The residents would like to be called when the building permits come into the Town Offices.

Commissioner Atkins made a motion to not recommend the Vacation and Replat of Lakeview Heights Unit 2 4th Amendment seconded by Commissioner Brown. Motion fails 2aye 3 nay.

Commissioner Cooper made a motion to recommend the Vacation and Replat of Lakeview Heights Unit 2 4 th Amendment with the understanding that there will be no conservation/preservation easement on the back side of lots 1, 2, & 3 as replated , seconded by Commissioner Cornell. Motion passess 3 aye and 2 nay vote.

Commissioner Cornell made a motion to adjourn at 8:35p.m., Seconded by Commissioner Cooper. Motion carries unanimously.

Approved as written or amended on February 15, 2006.
