Planning Commission Meeting
February 15, 2006

The Palmer Lake Planning Commission was called to order by CO - Chairperson Trombley at 7:05 p.m. in the Palmer Lake Town Hall .

ITEM #1: Call to Order: 7:00 p.m.

ITEM # 2: Comments by Commissioners, Staff or Public on items not on the agenda

No public input

ITEM # 3: Approval of Minutes – December 21, 2005 & January 18, 2006

Commissioners stated that they did not receive either set of minutes. And would like to hold them until March, 2006.

ITEM# 4: Request for a vacation and replat – 0 Hoover Lane – Dee Bass
(71082-20-003 & 71082-20-013)

  • 0 Hoover Lane – 16 & 17 block 44
  • Change lot sizes
  • Vacate access road
  • Replat 16 & 17
  • Would like to have 2 building sites
  • There are currently no utilities in the access road

Commissioner Cooper made a motion to recommend to Town Council the vacation and replat of 0 Hoover lane as submitted by the applicant seconded by Commissioner Brown. Motion carries unanimously.

ITEM #5: Request for a vacation & replat for Elliot's Corner – Corso & Buena Vista
Tom Day -Jeff Houchin
(71053-35-014 & 71051-36-005 & 71053-36-006, 71053-36-002)

Would like to vacate the interior lots lines and replat into 4 buildable sites.

Commissioner Atkins made a motion to recommend to Town Council the vacate and replat for Elliot's Corner as proposed seconded by Commissioner Cornell. Motion carries unanimously.

ITEM# 6: Request for a amendment to a Planned Unit Development (PUD) for Lot 4 Rancho IRACEMA – Inn at Palmer Divide – Al Fritts

Al Fritts - Requesting to have the current 27.12 acres subdivided into 2 parcels (13 acres & 14.12 acres)

  • Purpose of retaining a clear title to the 13 acre to use in the future to guarantee the success of the Inn.
  • Average slope is 9.78% which means that the property does not fall within the hillside ordinance
  • The property will be reseeded and re-landscaped when permitted
  • Nothing will be built on the 13 acres without coming back to the Planning Commission and Town Council for final approval and an amendment to a PUD
  • The 13 acres will remain within the current zone (PUD)
  • Detention Pond is all that is currently allowed on the 13 acres
  • Plans to complete the entire project by October 2006

Public and Commission Members:

  • No access and No water
  • State will not grant any more wells for that property
  • Will not grant a CO (Certificate of Occupancy) until all requirements of the PUD is met including the detention pond
  • CDOT will not grant any more curb cuts between MTI and Red Rock Ranch Road
  • Should wait until the leverage is need before the subdivision is granted

After detailed discussion the following motion was made:

Commissioner Cornell made a motion to not recommend to Town Council for approval for the amendment to a PUD Inn at Palmer Divide for a subdivision of the 27 acres Seconded by Commissioner Cooper. Motion fails 2 aye 3 nay

Commissioner Brown made a motion to recommend to Town Council the approval for the amendment to a PUD Inn at Palmer Divide for a subdivision of the 27 acres with the situplation that Town Council is to receive more information on the Detention Pond, Access to the divided parcel, easements for Detention pond and Sewer Line along with water availabilty for the divide parcel Seconded by Commissioner Atkins. Motion carries 3 aye 2 nay

Commissioner Cornell made a motion to adjourn at 9:05 p.m., Seconded by Commissioner Cooper. Motion carries unanimously.

Approved as written or amended on March 15, 2006.
