The Palmer Lake Planning Commission was called to order by Chairperson Cressman at 7:03 p.m. in the Palmer Lake Town Hall.

ITEM # 2: Comments by Commissioners, Staff or Public on items not on the agenda

ITEM #3: Approval of Minutes from July 14, 2004

COMMISSIONER TROMBLEY MADE A MOTION TO APPROVE THE MINUTES FROM JUNE 16, 2004, SECONDED BY COMMISSIONER SOLHEIM. MOTION CARRIES UNANIMOUSLY.

ITEM #4: Request for a vacation of an alleyway - (71051-21-011, 71051-12-008, 71051-12-006, 71051-21-010) Tim Shank

Mr. Shank request that the alleyway between (71051-21-011, 71051-12-008, 71051-12-006, and 71051-21-010) be vacated.

COMMISSIONER CORNELL MADE A MOTION TO RECOMMEND TO TOWN COUNCIL THE VACATION OF THE ALLEYWAY BETWEEN 71051-21-011, 71051-12-008, 71051-12-006, 71051-21-010 SECONDED BY COMMISSIONER COOPER. MOTION CARRIES UNANIMOUSLY.

ITEM # 5: Request for a sign permit Custom Home Theater - 780 Suite A HWY 105

COMMISSIONER SOLHEIM MADE A MOTION TO APPROVE THE SIGN PERMIT FOR CUSTOM HOME THEATER WITH THE UNDERSTANDING THAT IF THE APPLICANT PLACES THE SIGN IN THE STATE HWY ROW AND IF ASKED HE MUST MOVE IT SECONDED BY COMMISSIONER COOPER. MOTION CARRIES UNANIMOUSLY.

ITEM #6: Request for a vacation of a Street Right-of-Way (Portions of Loveland and Epworth HWY) - George Parsons and David Bolko

Mr. Bolko asked that this item be tabled until he can obtain a letter from a surrounding property owner.

COMMISSIONER TROMBLEY MADE A MOTION TO TABLE THE REQUEST FOR A VACATION OF A STREET RIGHT-OF-WAY (PORTIONS OF LOVELAND AND EPWORTH HWY) SECONDED BY COMMISSIONER COOPER. MOTION CARRIES UNANIMOUSLY.

ITEM: # 7: Request for a recommendation/review of a development plan for a right-of-way on Meadow Lane - Randy Jones

Mr. Jones asked for a recommendation on the proposed road construction for Meadow Lane. The platted road currently has some trees that are in the right-of-way and would like to know what the Planning Commission recommends happen to those trees.

COMMISSIONER COOPER MADE A MOTION TO RECOMMEND TO TOWN COUNCIL THAT THE TREES BE REMOVED IN ORDER FOR MEADOW LANE TO BE BUILT. WITH THE UNDERSTANDING THAT IF SOME OF THE TREES CAN BE MOVED TO ANOTHER LOCATION THE DEVELOPER TRY AND DO SO, SECONDED BY COMMISSIONER CORNELL. MOTION CARRIES 6 AYE 1 NAY.

The following list was comprised by Commissioner Atkins for the Town Council to consider regarding Randy Jones' project:

  1. Drainage Study
  2. Erosion Control
  3. Possibly a replat of the said lots
  4. Storm water discharge permit
  5. New DOW Mouse study (and any other wildlife)
  6. Pave the road
  7. Cross culverts 100ft apart to channel water
  8. Bring cul-de-sac out of wetland
  9. Re-visit fire letter
  10. Re-vegetate
  11. Lots 55, 56 & 57 out of platted road
  12. Old cul-de-sac/possible vacation
  13. Road width is a constant 24ft.
  14. Address the land swap
  15. Downstream impact/2nd culvert
  16. Access issue
  17. Paving 1st extension/curb & gutter

After further discussion a majority of the Commission agreed that this list may be presented to Town Council for review.

COMMISSIONER COOPER MADE A MOTION TO ADJOURN AT 7:55PM, SECONDED BY COMMISSIONER SOLHEIM. MOTION CARRIES UNANIMOUSLY.

Approved as written or amended on October 20, 2004.
